The case

On 6 August 2018, two members of the trade union working at a factory reached out to the FWF complaints handler in Tunisia. The complainants claimed that over the last few months, the amount of production taking place in the factory has greatly decreased. Furthermore, the complainants noted that they are no longer producing for Havep, that there is no import and export and that they have only received a few orders from a new local client.

The complainants furthermore stated that they did not receive July's wages and did not take their annual leave. The complainants tried to see the manager to ask for explanations of the company's situation but she refused to see them. On Monday 6 August 2016, the complainants and the other workers found the factory closed. They do not understand what is going on, especially the fact that the new local client has introduced himself as the new owner of the factory.

The complainants asked FWF for explanations and help. The FWF complaints handler in Tunisia encouraged the complainants to submit a complaint to the local Labour Inspectorate.

Findings and conclusions

The FWF complaints handler in Tunisia contacted the worker, who explained that after a big protest of all workers (they blocked the doors of the factory for a whole day) and the intervention of the Labour Inspection and the Governor of El Kef, they succeeded in obtaining their wage of the month of July and a paid holiday of 18 days.
In addition, the complaints handler in Tunisia contacted the general secretary of the Kef regional trade union to learn about the current situation at the factory. The secretary was aware of this case, follows the case and confirmed that the legal procedure is respected. All workers have received all their rights (July's wage and annual leave of 18 days). The secretary is aware of Havep no longer sourcing from this factory.

To verify, the local complaint handler in Tunisia contacted the complainant once more, who confirmed receiving payment of the wage of month July and the annual leave payment (18 days). Factory was closed for annual holidays until 10 September.
The owner and the manager of the factory remain the same. The owner explained to the workers that Havep is no longer a client and the factory signed a new agreement with a local client, who was also introduced to the workers.

As the workers received all their due payments, the complaint has been resolved.
