The complainant claimed that she is sometimes not allowed to go to the toilet during working hours, although she has a medical problem that requires regular visits to the toilet(6-7 times per day)and the use of medication. Although she has discussed this problem with her manager and has she has showed proof of her illness, i.e. a letter of an urologist, she was refused to make use of the toilet more often.She would like to have free access to the toilet for medical purposes. Furthermore, the complainant complained about the communication of this new manager, since she would shout and scold. More than being suspended, she feels that the way she was spoken to and the lack of respect is a bigger problem.

Findings and conclusions

The complainant claimed that she is sometimes not allowed to go to the toilet during working hours, although she has a medical problem that requires regular visits to the toilet(6-7 times per day)and the use of medication. Expresso contacted the factory manager. The manager confirmedthat there was a factory rule that people cannot go to the toilet during the first half an hourof the workingday and half an hour before the end of the working day.The rule would preventworkers from leaving their workstation at the endof the day to wash themselvesand stop production.According to the manager, workers misusethe last half an hour to wash themselves instead of continuing production.In the case of the complainant, the manager confirmed that she is free to make use of the toilet for medical purposesduring the entire day.According to the manager, the worker misused her right to make use of the toilet for medical purposes to washherself
Fair Wear Foundation complaints report –Date of reporting:26 September 20163/ 3in the last half hourof the day. Although the suspension was initially for three days, they reduced this to only 1 day.
Due to holidays, the local FWF complaints handler was not able to do an on-site investigation at the time. During the holidays, the factory manager decidedto cease activities and file for a bankruptcy. The factory is now in the process of liquidation. Therefore, no further follow up could be given to the complaint. FWF did open a new complaint with regard to the bankruptcy of the factory.
