The complainant has worked for the factory since 2009. She would like to terminate her labour contract with 45 days of prior notice but the factory has not provided her the factory's termination form.

On 20 March 2019, she sent her own termination letter to her line leader and she also sent a copy of termination letter to the local authority. After that she called the Fair Wear helpline to help her to terminate her labour contract legally.
The Fair Wear complaints handler advised the complainant to contact the HR manager or the labour union first. Then call back if she still need help.

On 3 April 2019: The complainant called back. She has met with the HR Manager, who sent her termination letter to the factory manager who then sent her termination letter to the production manager. The production manager replied that the complainant's termination has not yet been resolved. The complainant would like Fair Wear to help her resign legally.

Findings and conclusions

A worker who worked for the factory since 2009 called Fair Wear helpline on March 20th 2019. She send a notice to terminate her labor contract with 45 days of prior notice but the factory has not provided her the factory's termination form.

On 3 April 2019: The complainant called back. She has met the Hr Manager who sent her termination letter to the factory manager, who sent her termination letter to the production manager. The production manager replied her that her termination was not accepted yet.

On April 15th, the brand informed the factory and asked them to investigate the case.
The factory answered that, on April 16th, the worker met with factory managers (HR manager, Work shop manager, Line leader) and agreed to continue working with the factory. The factory said they will share the termination form with worker and mark issue date once they received it.

FWF would like to recommend that the factory shares the termination process and explains it to all workers.

The worker confirmed that she continues to work at the factory and stopped the complaint. She thanked FWF for helping her.
The complaint is thus marked resolved on 2nd May 2019.

Schoeffel asked Fair Wear to share the name of the complainant in order to share it with the factory to conduct the investigation.

On April 15, the brand informed the factory and asked them to investigate the case.

2019-04-25 Remediation

Factory management answered that:
- Factory received the termination letter from a worker in line 13
- Factory managers (HR manager, Work shop manager, Line leader) and the complainant had a discussion in operator office on 16 April
- After the discussion, the complainant agreed to keep working in the factory

To avoid same issue, the factory said they will share the termination form with workers and mark the issue date once they receive it. Workers can cancel their decision to resign within 30 or 45 days depends on labour contract term. Factory management will respect workers' decisions and will try to prevent same problem from reoccuring in the future.

Fair Wear would like to recommend that the factory shares the resignation process and explains it to all workers.

The complainant confirmed that she will continue to work in the factory and would like to stop the complaint. She thanked Fair Wear for helping her.
