A worker wants to complain that from the beginning of July, workers have to punch their time record then return to work. This issue occurs at Factory 2, from line 10 to line 24. If workers work until 19:30, they are required to punch their time record at 16:30. In case working until 21:00, they have to punch their time record at 18:00. If workers do not do that, they will be scolded by line leaders or supervisors or be threatened with dismissal. The complainant wishes that FWF can help workers to stop this violation of the Code of Labour Practices (CoLP).
The FWF complaint handler first asked the complainant whether he/she is in touch with the internal grievance system but he/she said that nobody dares to complain because they are afraid of losing their jobs

Findings and conclusions

On 8 July 2019, FWF complaint handler in Vietnam received a call from a worker who claimed that since the beginning of July, workers had to punch their time record and then return to work. If workers worked until 19.30, they were required to punch their time record at 16.30. When working until 21:00, they had to punch their time record at 18:00. If workers did not do that, they would be scolded by line leaders or supervisors or be threatened with dismissal.

On 18 July 2019, the FWF brands sourcing at this factory informed the factory management about the complaint. The factory replied that at the beginning of July 2019, the line leader had asked workers to work overtime without informing to the top management. The factory communicated that they intended to eradicate overtime and overtime registration issues in the future. This would be done through sharing the policy with workers, checking records of overtime and make sure workers did not go back to work after checking out. The factory would also plan training of management and line leaders about the factory's policies and workers rights, quarterly. The factory shared the pictures of a first training which took place on 22 July 2019.

FWF complaint handler tried to contact the complainant to verify the remediation steps taken by the factory but could not reach him/her. On 25 August, the complaint handler managed to talk to another worker form the factory. That worker said that in early August, he/she saw the team leaders and supervisors attending several meetings and they informed workers that there had been complaints about overtime registration to the suppliers. Therefore the factory forbid the line leaders and supervisors to ask workers to do overtime without approval from the factory management. From early August until end of August, there was no overtime work after 18:00 and no one returned to work after 18:00.

Since the complainant could not be reached and because overtime is an issue that needs to remain under close monitoring, this complaint case was closed on 29 August but not marked as resolved.

2019-08-05 Remediation

The factory replied that: at the beginning of July, 2019, the line leader asked workers to work overtime (OT) without informing the top management.
The local compliance team's intention is to eradicate and crack down on irregular OT in the future.

The factory will manage and announce overtime as follows:

- Making announcement via speaker to all workers and posting announcement on bulletin board stating that the company does not accept any managers or leaders to request workers to work OT without registration. The most important thing is that working OT is voluntary, not forced.

- The security team will have a close look at tagging time check card area and will not allow any workers to return to their section after checking out. Also, they will check CCTV daily to make sure everything is fine.

- The HR & Compliance team will be in charge of checking and comparing the actual situation in lines with registered overtime form daily.

- If workers work OT without registration, The general team will ask them to stop OT and go back home immediately.
Also the line and leader will be reported to the top management.

- Workers have right to inform/complain to the board of directors, HR department or trade union via calling company’s hot line,
putting complaint letter into suggestion box or talking directly with trade union. The company really appreciates worker’s behaviour and promises to keep protecting an accuser’s identity.

- HR department conduct training to all managers, leader about company’s policies and worker’s benefit quarterly.
Moreover, they will monitor whether they comply company’s policies or not. If found any person violate company’s policies will be handle with company’s regulation.

The factory also shared a CAP file with pictures of the first training held on 22 July.

2019-08-14 Investigation

The complaint handler tried to reach out to the complainant several times without success

2019-08-25 Investigation

On 25 August, the complaint handler managed to talk to another worker form the factory. That worker said that in early August, he/she saw the team leaders and supervisors attending several meetings and they informed workers that there were some workers complaining to the customer, therefore the factory has forbidden the line leaders and supervisors to require workers to work overtime without approval from the factory management. From early August until end of August, there was no overtime work after 18:00 and no one has returned to work after 18:00.
