The worker fell down the factory steps which resulted in a fracture. Factory management did not pay the full amount for the medical expenses incurred nor the sick leave, both of which the worker was entitled to.

The management agreed to pay the full amount owed to the worker on Saturday 2 November along with the regular weekly pay. FWF's complaints handler checked with the complainant on Monday 4 November and the full amount has been given to the worker as agreed.

Overview of the complaint investigation

2013-09-16 Investigation

According to the Workmen's Compensation Act 1923 (amended in 2009) the factory management has to compensate the worker for sick leave, if he/she has worked for more than 6 months continuously.

FWF staff met with the plaintiff and factory management. Factory management has paid first part of medical expenses but no follow up visits at the doctor. The plaintiff did not get any sick leave payment.

McGregor stressed the importance of accurate payments towards the factory management.

2013-10-09 Conclusion of the investigation

The Workmen’s Compensation Act 1923 (amended in 2009) applies to the plaintiff. All medical expenses as well as sick leave payments have to be paid by factory management to the injured worker.

2013-10-16 Remediation

Medical expenses as well as sick leave payments have to be paid by factory management to the worker. Agreement is to pay the full amount on Saturday, 2 November with the regular weekly pay.

2013-11-04 Verification

FWF staff checked with the worker Monday, 4 November. The full amount has been given to the worker as agreed.

2013-11-04 Evaluation of the complaint

The plaintiff has given a letter of thanks to the trainer and local FWF partner for solving the complaint.

The complaint has been resolved.
