The complainant has been employed as a tailor in this factory for a year and three months. Two months ago, the complainant's supervisor asked him/her to fill in as a helper, as several workers were on leave. The complainant stated to have agreed on this on several occasions previously. However, the complainant pointed out that this has been occurring more frequently in recent times, and, concerned, he/she raised the issue with the supervisor. According to the complainant, the supervisor responded by verbally abusing him/her and demanding that he/she leaves the job immediately. The complainant went to the HR manager to protest but no action was taken, and the complainant left immediately. Furthermore, the complainant stated that many workers are harassed in this way by this supervisor. The complainant signed a resignation letter upon leaving but stated that the dues were not settled.

Findings and conclusions

On 2 March 2018, FWF complaints handler in India received a call from a factory worker, who claimed that his/her contract was terminated by the factory but that he/she had not received the due payments. The complainant claimed that, on several occasions, he/she was asked by the supervisor to work as a helper. He/she agreed but when this request became frequent he/she objected. The supervisor reacted aggressively and asked him/her to leave the job. The complainant left the job without his/her dues being cleared by the factory. With the brand's intervention and FWF's support, the factory paid all due payments. The complainant was satisfied with the outcome of the complaint and the complaint has been resolved.

Overview of the complaint investigation

2018-03-02 Investigation

FWF informed Mini Rodini about the complaint on 2 March 2018. The relationship with the factory has been difficult lately, partly due to a number of complaints received through the FWF hotline. Mini Rodini, therefore, planned a visit in April 2018 to discuss the cases and general cooperation on improving working conditions. Mini Rodini informed FWF about the outcome of the meeting on 13 June 2018.

2018-06-27 Conclusion of the investigation

Management denied the version of the complainant and stated that the worker was demoted permanently to helper level because of unsatisfactory performance. According to factory management the company did, however, continue to pay his/her previous (higher) salary. According to the factory, the worker left on his/her own will after the demotion and has received all due payments.

The version of management is contradictory to the version of the complainant. Based on the information provided, FWF cannot conclude whether legal procedures have been followed. Mini Rodini should ask the factory to provide documentation of the demotion, salary development and resignation/dismissal of the worker.

2018-10-15 Remediation

There has been no response from the factory/management on sharing further documentation with regard to the complainant's dismissal. Notwithstanding the documentation, FWF urges the factory to clear the dues to the worker.

2018-10-31 Verification

The FWF complaints handler made a follow-up call to the complainant and was informed that all dues were settled by the factory. He/she also received the PF (social security) amount from the PF department and is currently working in another factory.

2018-11-05 Evaluation of the complaint

The complainant appeared to be happy that his/her claims were settled.

2018-11-05 Resolved

Since the payment to the complainant was made to his/her satisfaction, we can consider the complaint resolved.
