The plaintiff has been working at the factory for over 3 years, and wanted to take “earned leave”. But he found out that his other colleagues could not get it. And he thought that earned leave was the only leave workers are entitled to. He only came to know from FWF that there are other types of leave that the workers can have (casual leave, sick leave). The plaintiff said that the factory deducted 12,000 – 15,000 kyats for a day of absence. As the factory does not allow the workers to take leave, workers will be recorded as “absent” whenever s/he has reasons to take leaves such as family health, sickness. Workers also don’t get the gate pass to go home if they feel sick during the day.

The plaintiff furthermore informed FWF of a case of two female workers, who are sisters, who were not allowed to go home during their mother’s emergency because they were assigned in the same line. When the workers told the factory manager that they would resign from the factory if they were not allowed to leave, one worker received permission to go.

Findings and conclusions

On 23 June 2017, FWF’s complaints handler in Myanmar received a complaint from a factory worker, who claimed that workers are not allowed to take earned leave. As the factory does not allow the workers to take leave, workers will be recorded as “absent” whenever s/he has reasons to take leaves such as family health, sickness. The plaintiff indicated that the factory deducted 12,000 – 15,000 kyats for a day of absence. The complainant also indicated that workers have no knowledge about other types of leave, such as sick leave and casual leave. FWF declared this complaint admissible and informed Takko, the FWF member sourcing at this factory. Takko reached out to factory management. However, on 24 July 2017 the factory management sent Takko an official statement that they will stop business with Takko after the current orders are shipped. Henceforth it was impossible to follow-up on the complaint. FWF advised the complainant to contact the local labour office.

Takko asked the factory management for a response. However, on 24 July 2017 the factory management sent Takko an official statement that they will stop business with Takko after the current orders are shipped. Henceforth it was impossible to follow-up on the complaint. FWF advised the complainant to contact the local labour office.
