The complainant is a sewing line helper under probation. She was fired on 11th November, 2017 by the local manager because the administrative office staffs complained that she was rude towards them. The complainant claimed that she did not use any rude words and had never been given warning letter, late or absent.

According to the complainant, she worked on 2nd November 2017, which was a public holiday, believing that she would be paid double (2700 MMK x 2 = 5400MMK). The payday is on 8th but she was not paid on the same day because it was so late that her supervisor told her that she would be paid the next day. On 9th afternoon around 11:55am, she was paid but she found out with the help of her friends (she doesn’t know math) that 10600 MMK from her salary was missing and the public holiday overtime wage is only 4400 MMK. When she complained about the missing amount (10600 MMK) to her supervisor, she told her not to complain it to office and that, she would take responsibility and pay her next pay day. Being encouraged by her friends to ask for the remaining money, she went to the office to inform about it. The HR staffs said that since it was already in her hand, there was nothing they could do. They had small argument but she just came back to the production line. She told her friends about what happened and continued working. In the afternoon, she was called to the office to meet the local manager because the HR staffs informed that she was aggressive and cursed to them in the production line. She was convinced to resign and was paid 28,800 MMK for the days she had worked. She took the money and the documents she submitted to apply the job. It was learnt through the phone call that she wanted to get her job back.

Findings and conclusions

However, the phone was not picked up, and thus the case was closed.
