The complainant reported that the factory refused to pay the promised attendance bonus when (s)he resigned. The factory promised that the workers, who were not absent in April, would be paid 20,000 MMK as an incentive on 25th May. The complainant claimed that (s)he was not absent even when the factory asked them to work during the Water Festival Holidays because (s)he wanted to receive the incentive. On 21st May, the complainant resigned as the factory did not allow him/her to take leave. On 25th May, the complainant went to the factory to get the promised incentive but the HR Department told him/her that the resigned workers would not get the incentive. So,(s)he contacted FWF on 26th , (s)he informed the complaint handler that the factory announced to his/her colleagues that the payment had been postponed to 5th June. On 5th June the factory still did not pay him/her.
On 3rd July the member informed FWF that the factory was not reachable since the CSR manager was hospitalized.
On 30th July 2018, the factory replied that as the complainant did not work the full month in May, she/ he could not get the attendance bonus. The salary, including the attendance bonus, for April was paid on 5th May. According to the attendance bonus policy, the factory will pay full-attendance bonus of 15000MMK for the workers who were not absent in one full month. Workers who apply for leaves will be deducted by 5000MMK per day. The monthly wages will be paid on the 5th of the month after the working month.
The factory replied that as the complainant did not work the full month in May, she/he can’t get the attendance bonus. The salary, including the attendance bonus, for month April was paid on 5th May.
In September, during the visit of the brand, a meeting was set up between the brand and Fair Wear local team to discuss the complaints. Fair Wear explained that this complaint was not about attendance bonus but about the extra attendance incentive that the factory promised to pay workers in order to motivate them to work during water festival holiday.
The brand conducted investigation in the factory and submitted related documents to Fair Wear for verification.
During the investigation, it was found that the attendance incentive was indeed promised by the factory but one of the criteria was that the incentive would not be provided to the workers who resigned before 25th May. Since the complainant resigned before 25th May, she/he would not be entitled to the incentive although she/he worked during the holidays.
The complainant is no longer reachable for evaluation of the complaint.
