The complainant claimed the factory does not pay monthly salary on time. Secondly, according to the complainant the factory forced the worker to work overtime, from 5pm to 8pm.

Findings and conclusions

The complaint was received through FWF’s local complaints handler in Vietnam on 17 December 2014.
FWF decided that the case is admissible 17 December 2014. The factory is an active supplier of Vaude. The complainant claimed the factory does not pay monthly salary on time. Secondly, according to the complainant the factory forced the worker to work overtime, from 5pm to 8pm.
FWF informed Vaude about the case who requested a reply from the factory. Factory management state they currently have a difficult financial situation and experience capital shortage in November and December 2014.
FWF’s complaints handler checked the above points with the complainant.More specifically to verify that:1)overtime was indeed voluntary and only happens occasionally 2)all actions have been communicated to workerse.g they are aware of the overtime agreement, the reason of delayed payment and of what will happen to improve the pay situation and 3)the workers in the washing department have indeed been compensated for not receiving the allowance during production stoppage.
The mother company of the factory couldsupport payment on time by covering the CMT costs in advance.The reason for delay of payment and actions taken to improve the situation must be communicated to workers. Vaude is to monitor whether this has happened.
Since Vaude has stopped sourving at that factory, the complaint is closed.

Overview of the complaint investigation

FWF informed Vaude about the case who requested a reply from the factory. Factory management state they currently have a difficult financial situation and experience capital shortage in November and December 2014. Goods (that were not Vaude orders) were not yet shipped and they can only receive payment after the goods are shipped. Factory committed to improve the pay situation with support of the mother company.
Factory confirmed overtime took place because of tight delivery. According to factory management workers had agreed a signed to work overtime and overtime premiums were paid according to local law. An agreement was forwarded to FWF between the factory and the labour union on overtime. The agreement is said to be posted in public.
Factory management confirmed workers did not receive allowance during a production stoppage; this happened to the washing department. Factory committed to compensate their loss if salary is below minimum wage.

More specifically to verify that: 1) overtime was indeed voluntary and only happens occasionally 2) all actions have been communicated to workers e.g they are aware of the overtime agreement, the reason of delayed payment and of what will happen to improve the pay situation and 3) the workers in the washing department have indeed been compensated for not receiving the allowance during production stoppage.

The mother company of the factory could support payment on time by covering the CMT costs in advance. The reason for delay of payment and actions taken to improve the situation must be communicated to workers. Vaude is to monitor whether this has happened.
