The complainant reported that the factory had been demanding excessive overtime (OT) until 20:00 every Saturday for the entire month. Usually, on Saturday the factory demands overtime until 16:30 (five hours of OT) but at the time of the complaint three more hours of overtime were being requested by factory management. Although it was announced to everyone that overtime should be voluntary, the workers were afraid of their supervisors and did not dare to refuse. The complainant commented that many female workers were worried about their safety when they had to travel home late, despite the fact that the factory paud them for transportation (500 MMK).

Note: On Saturday, any hours worked beyond the four regular working hours should be considered as overtime.

Findings and conclusions

On 19 July, 2019, FWF’s complaints handler in Myanmar received a complaint from a factory worker, who claimed that the factory had been demanding excessive overtime until 20:00 on Saturday for the entire month. Usually, the factory demanded overtime until 16:30 on Saturday (five hours of OT) but at the time of the complaint three more hours of overtime were being requested by factory management. Although it was announced to everyone that overtime should be voluntary, the workers were afraid of their supervisors and did not dare to refuse. The complainant commented that many female workers were worried about their safety when they had to travel home late, despite the fact that the factory paud them for transportation (500 MMK).

FWF declared this complaint admissible and informed Vaude, the FWF member sourcing at this factory. Vaude reached out to factory management, who indicated that there was excessive overtime for a short period because of a Japanese order. However, factory management stressed that the overtime was consensual.

FWF advised the brand to encourage the factory to reduce their overtime hours to comply with the local laws. At the same time, and in consultation with the brand, FWF pointed out to workers that they should feel free to refuse overtime if they do not wish to do it. The brand stressed to factory management that excessive OT is not acceptable. Furthermore, the brand indicated to factory management that they would monitor working hours carefully and would do an overtime analysis at the factory on a monthly basis until the end of 2019.

When FWF called the complainant to check about overtime hours, the complainant informed that the factory had stopped with the excessive overtime and workers were satisfied.

This complainant is resolved.

Overview of the complaint investigation

2019-08-02 Investigation

FWF informed the FWF member company, Vaude, sourcing at the factory. The brand clarified some issues with FWF before approaching the factory management. FWF clarified that the workers never dared to refuse overtime. Furthermore, workers indicated that they are okay with 5 hours of OT on Saturday, but not an additional three; also as that would complicate their journey home and make this more hasardous. Workers furthermore indicated that their main complaint was not with the supervisors, but with the production planning.

2019-08-02 Investigation

The FWF brand sourcing at the factory, Vaude, contacted the factory management, which responded that the overtime is voluntary and is under legal limits.

2019-08-09 Remediation

The brand replied that the factory worked excessive OT and that this is not accepted. The factory indicated to the brand that it was only for a short time because of Japanese order.

The brand is monitoring working hours carefully and is doing an overtime analysis at the factory on a monthly basis until the end of the year.

FWF complainant suggested that the brand encourages the factory to avoid working excessively while the complainant will be encouraged to deny the overtime if they do not wish to work.

2019-09-15 Evaluation of the complaint

The complainant confirmed that the excessive overtime has stopped for almost a month now and the workers are happy.
